Terms and Conditions

1. BOOKINGS

To secure your desired date and discuss any specific needs with the artist, please fill out the inquiry form. Confirmations for bookings will only be made once the form is submitted and the deposit is paid.

2. BOOKING FORM

Before submitting this booking form, we kindly ask you to read the terms and conditions thoroughly. If you have any questions or require clarification, don't hesitate to reach out to us. You have the option to cancel your booking within a 7-day cooling-off period following your booking confirmation. The completed booking form will act as the contract between the hirer (Client) and Maurice Vocal Rhapsody (The Singer/Duo/Trio Artist) for your event.

3. PAYMENTS AND COOLING-OFF PERIOD

A reservation fee of $100 is needed when you submit the booking form, and this amount will be deducted from the total cost of your booking. Please note that the reservation fee becomes non-refundable after a 7-day cooling-off period. The remaining balance must be paid 14 days prior to the scheduled date. The cooling-off period begins once the client pays the reservation fee and the booking is confirmed.

4. DATE CHANGES/CANCELLATIONS

  • A written request should be sent to miss.mauricemarcelo@hotmail.com if the client wishes to reschedule the engagement. This request must be made at least 30 days prior to the originally scheduled date. Changes will depend on the artist’s availability. If the artist is not available on the new date and both parties cannot find a mutually agreeable alternative, the booking will be canceled. In this case, cancellation charges will apply, along with the loss of the reservation fee.

  • Cancellation Policy for Client Engagements
    If the client cancels the engagement after the 7-day cooling-off period but before 60 days prior to the event, only the $100 reservation fee will be forfeited. Cancellations made prior to the event will incur the following fees:

 

• Cancellation 60 days before the event – 50% of the total amount is due and non-refundable

• Cancellation 30 days before the event – 100% of the total amount is due and non-refundable

  • The Artist reserves the right to terminate this contract without any liability, other than providing a full refund to the client, if they are unable to reach the venue or perform due to circumstances beyond their reasonable control. This may include, but is not limited to, the following scenarios:

• Fire or theft of equipment or vehicle
• Illness or injury that prevents the Artist from performing
• Vehicle breakdown or accident
• Severe or unavoidable travel delays
• Other emergencies

  • As the contracted supplier, the Artist's liability in the rare event of a cancellation is limited to the amount specified in the contract. If possible, the client may be offered an alternative or replacement performer(s).

5. SETUP/PACK DOWN TIME, ACCESS & SPACE REQUIREMENTS

  • The artist is expected to arrive at the venue at least one hour prior to the scheduled time to set up and conduct a sound check of the equipment. It's crucial that the artist has direct access to the performance area and that the loading distance for equipment is as short and straightforward as possible. Once inside, the artist will need a minimum of one hour of unrestricted access to arrange and test the equipment before the performance begins, as well as an equal amount of time afterward for packing up. Additionally, a space of at least 1.5m x 1.5m is required for a solo act, and 3m x 3m for duos or larger groups, along with access to a power outlet within 10 meters.

  • At the artist's discretion, early setup may be necessary, and it is requested that the contact details of the venue or events manager be provided to facilitate a smooth set-up.

  • ​

6. TRAVEL

  • Two-way travel within 30km of Perth is included in the price package. Anything outside this radius is charged at $1.50 per km per musician/artist by road. For locations outside of Perth, i.e., regional/international, charges for air travel will apply.
  • The artist needs one parking space, with the associated costs billed to the client.

7. OVERTIME RATES AND ADDITIONAL FEES

  • Notification: Clients should provide at least 30 minutes' notice prior to the end of the originally booked time to allow for any necessary arrangements.

  • Payment Methods: The accepted payment options for the extended rate are cash and bank transfer, both of which must be completed before the extension of performance. The fee for an extension is $250.00 per hour for the lead artist and $200.00 per hour for each additional musician.

  • Performance Continuity: The quality of the performance will remain consistent during the extended time, as all singers and musicians are committed to delivering an exceptional experience regardless of the duration.

  • Agreement Terms: Any prior agreements related to performance extensions should be reviewed to ensure all parties are aligned on expectations and rates.

  • Cancellation Policy: In the event that the client decides to shorten the extended time or cancel it altogether, a notice should be given at least 15 minutes before the new ending time to avoid any additional charges.

  • The song list may not be updated. If the requested song is unfamiliar to the singer, please confirm with Maurice, as there could be an additional fee of $100.00 for the singer to learn it.

8. PERFORMANCE

  • The artist will deliver a performance that aligns with their promotional materials and/or audio/video samples, as previously discussed and agreed upon with the client. They will treat the client, their guests, and all venue staff with politeness and respect, while also honouring the client’s reasonable requests.

  • Guest Requests - The artist is dedicated to upholding professionalism at all times and will diligently fulfill the services for which they have been hired. If a guest at the event expresses a desire to sing using Maurice Vocal Rhapsody's equipment, the authority to grant or deny this request rests solely with Maurice Vocal Rhapsody. They reserve the right to decline any guest who wishes to sing if it may disrupt the entertainment that the artist has been contracted to provide.

9. SAFETY AND WELLBEING

  • The client acknowledges that if the artist faces any threats or verbal or physical abuse from anyone present before, during, or after a performance, the artist has the right to stop the performance immediately, without facing any penalties. All fees will still be due from the client.

  • ​

10. PUBLIC LIABILITY

  • The artist will take all reasonable precautions to ensure the safety of their equipment during the event.

  • In the event of any damage, the client agrees to compensate the artist for repair or replacement costs, as determined by a mutually agreed assessment.

  • It is recommended that the client communicate any potential hazards at the venue prior to the event, to minimize risks associated with equipment damage.

  • The artist reserves the right to halt the performance if they feel that their equipment is in jeopardy, ensuring the safety of both their work and the event attendees.

  • The client is encouraged to secure their own insurance for the event to cover any unforeseen incidents that might occur.

  • Any disputes regarding damages or responsibilities will be resolved through direct communication between the client and the artist, with the aim of finding an amicable solution.

    • By understanding these terms, both parties can ensure a smooth and enjoyable experience at the event.

11. FORCE MAJEURE

  • Neither party shall be liable for any failure to perform its obligations under this agreement if such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, epidemic, or governmental restrictions.

  • In the event of such a force majeure occurrence, the affected party shall promptly notify the other party in writing, detailing the nature and expected duration of the delay.

  • The affected party shall make all reasonable efforts to mitigate the effects of the delay and resume performance as soon as possible.

  • If the force majeure event extends for a period exceeding thirty (30) days, either party may terminate this agreement upon written notice to the other.

  • Such termination shall not constitute a breach of this agreement, and neither party shall have any further liability to the other except for obligations accrued prior to the force majeure event.

12. PHOTOS/VIDEOS

  • The artist retains the right to capture photographs and/or video recordings of the artist at any moment during the performance for purposes of self-promotion and publicity.
